1. Services Provided

Countrywide Public Adjusters offers public adjusting services to assist policyholders in assessing and negotiating insurance claims related to property damage, including but not limited to storm damage, fire damage, water damage, hurricane damage, and other covered perils. Our role is to act as the Client's representative in the claim process and to maximize the settlement of insurance claims in accordance with applicable laws and the terms of the Client's insurance policy.

2. Client Responsibilities

By engaging our services, the Client agrees to the following:

  • Provide accurate and complete information regarding the insurance policy, the damage sustained, and any other relevant details.
  • Cooperate with our team by providing access to the property, documentation, and any other necessary information to facilitate the claims process.
  • Notify us promptly of any changes in circumstances or information that may affect the claim.

3. Engagement of Services

Upon engaging our services, the Client will be required to sign a formal contract or agreement detailing the scope of services, fees, and any other necessary terms. This agreement may include a contingency fee arrangement, whereby our fees are based on a percentage of the final claim settlement. We will work diligently on the Client's behalf to obtain the best possible outcome for their insurance claim.

4. Fees and Payment

Countrywide Public Adjusters operates on a contingency fee basis, meaning that the Client only pays us if and when we successfully recover a settlement for their claim. The specific fee arrangement will be detailed in the engagement agreement and is typically a percentage of the amount recovered. Payment is due upon the successful settlement of the insurance claim, and no additional fees will be charged unless explicitly agreed upon in writing.

5. Confidentiality

We take the privacy of our Clients seriously and are committed to maintaining the confidentiality of all personal information and documentation provided to us during the claims process. Information will only be shared with third parties when necessary to process or settle the claim, and we will not disclose any information beyond what is required to fulfill our obligations.

6. Termination of Services

Both the Client and Countrywide Public Adjusters reserve the right to terminate the engagement of services at any time, with or without cause. If the Client terminates the agreement prior to the resolution of their insurance claim, they may be liable for any reasonable expenses incurred up to the point of termination. Similarly, if we choose to terminate the agreement, we will provide the Client with a notice explaining the reasons for the termination.

7. Limitation of Liability

While Countrywide Public Adjusters is committed to providing professional and high-quality services, the outcome of any insurance claim is not guaranteed. We cannot be held liable for any losses or damages arising from the rejection or underpayment of an insurance claim by the insurer. Additionally, we are not responsible for delays caused by the insurer or other third parties beyond our control.

8. Indemnification

The Client agrees to indemnify and hold harmless Countrywide Public Adjusters, its officers, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorney's fees) that may arise from the Client's failure to comply with the terms of this agreement, including providing false or misleading information.

9. Dispute Resolution

Any disputes arising from the use of our services or these Terms will be resolved through mediation or arbitration, as agreed upon by both parties, in accordance with the laws of the state of Florida. Should legal action be required, the parties agree to submit to the exclusive jurisdiction of the courts of Miami, Florida.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the state of Florida, without regard to its conflict of laws principles. Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of Miami, Florida.

11. Modifications to the Terms

Countrywide Public Adjusters reserves the right to modify these Terms at any time. Any changes will be posted on our website, and continued use of our services constitutes acceptance of the revised Terms. It is the Client's responsibility to review these Terms periodically for updates.
